New school fee
New school fee law will not apply in the current academic year: Delhi govt to SC
Government’s Clarification to the Supreme Court
The Delhi government informed the Supreme Court on February 2, 2026 that the Delhi School Education (Transparency in Fixation and Regulation of Fees) Act, 2025 — a law aimed at regulating how private schools fix fees — will not be implemented in the ongoing 2025–26 academic year. Officials made this submission amid legal challenges by private school associations and concerns about mid-year enforcement.
Reason for Deferring Implementation
The government explained that although the Act was officially notified in December 2025, implementing it midway through an academic session would be impractical. Since the detailed timelines provided under the Act for forming committees and approving fees had already lapsed, the state chose not to enforce the law for the current session.

Supreme Court’s Response
The Supreme Court recorded the government’s assurance and noted that no urgent judicial intervention was required once implementation was deferred. The Bench — led by Justices P.S. Narasimha and Alok Aradhe — had earlier expressed reservations about rushing the regulations into effect during an academic year already underway.

What This Means for Schools and Parents
With this clarification, private schools in Delhi will continue operating under the existing fee framework for 2025–26. The new regulatory regime — which includes fee committees and approval processes — is now expected to be applied only from the 2026–27 academic session. Parents and school bodies can thus expect no immediate change in fee fixation procedures for the current year.

Context of the Legal Challenge
The deferral came amid multiple petitions by private school managements challenging the Act’s application and deadlines. The Supreme Court had earlier questioned the government’s decision to implement the law part-way through a session and asked it to consider postponing enforcement until April or the start of the next academic year.
